    Jack the tripper,

Vad menar du med “lagförslag”? Motion, proposition?

AMSTERDAM (Reuters) – Dutch “coffee shops” famous for selling cannabis are about to see business go up in smoke.

Officials have just put the finishing touches to a measure banning smoking in cannabis-selling cafes. Due to get government approval soon, the law aims to protect employees of all companies from passive smoking.

“Any coffee shop that has employees will be affected too,” said Trudy Prins, director of Dutch anti-smoking group Stivoro.

Although cannabis is formally illegal in the Netherlands, its use and sale are tolerated under strict government conditions. Coffee shops, where customers can buy a small amount of cannabis without fear of arrest, are a major tourist draw.

Coffee shop owners were aghast. “The whole point of going to a coffee shop is to smoke,” said Arjan Roskam, chairman of the Union for Cannabis Retailers.

The Netherlands boasts around 800 cannabis cafes. Smoking a joint in an Amsterdam coffee shop vies with canal boat tours and trips to the flower market for a place on tourists’ itineraries.

Health Ministry spokesman Bas Kuik said the law was not intended to target coffee shops, and – as in all public areas – they could have designated smoking areas.

    Quote:
The infamous Dutch coffee shops have been placed at risk with news on Tuesday that the tolerated cannabis establishments will have to provide a smoke-free environment for staff from the start of 2004.
The news is sure to delight conservatives who have tried in vain for years to get rid of the coffee shops with legislation, police raids and tax audits. And in a reaction to the news of the looming smoking ban, Amsterdam coffee shop manager Dick Langereis told Wednesday’s edition of newspaper Trouw: “We might as well close up” and “Gilbert”, the owner of a coffee shop in Nijmegen, quipped: “I can only laugh”. But a Health Ministry spokesperson confirmed to the newspaper that as of 1 January 2004, cannabis cafes would have to provide a smoke-free work environment for staff. There are thousands of coffee shops in the Netherlands with about 300-500 in Amsterdam alone.

“The rules apply to everyone. Anyone with staff must ensure from 1 January 2004 onwards that their employees can work in a smoke-free environment. That applies to cigar shops as well as coffee shops,” the ministry spokesperson said.

The horeca sector (restaurants, cafes and hotels) have been granted a 12-month reprieve before they have to introduce the measure. But on Tuesday, sector organisation Koninklijke Horeca Nederland (KHN) warned the regulation would destroy 50,000 jobs and cost the sector EUR 1.3 billion in annual turnover. Coffee shops do not come under the horecawet (horeca law) and therefore do not have the benefit of the “stay of execution”. The Health Ministry said the cannabis establishments, like tearooms — which are mostly frequented by immigrants — and lunchrooms will have to adopt the new regulation by January next year.

The coffee shop sector had an estimated turnover of EUR 300 million in 1999 and its supporters argue that all its staff are “smokers” who would not be interested in turning their workplace into a smoke-free environment.

Most coffee shops are relatively small and given that smoking is the primary activity, it would be almost impossible to provide a smoke-free environment for staff. About 200 people die in the Netherlands every year from lung cancer caused by passive smoking and recently toughened anti-smoking legislation stipulated that from 1 January 2004, employers must ensure that their employees are not exposed to tobacco smoke.

The law states that every worker has the right to a smoke-free workplace and it is the employer’s responsibility to determine whether staff members are being exposed to cigarette smoke. Employers will be fined if they do not meet the law’s requirements. The legislation is not a general ban on smoking, such as the smoking ban imposed on all public transport, which comes into effect on 1 January 2004, when smoking carriages in trains will disappear. Smoking is already forbidden in most buses, trams and metros around the country. But the entertainment industry was temporarily spared from the smoke-free workplace legislation, allowing patrons to continue to light up in restaurants, cafes and hotels for an extra 12 months. The government informed the Lower House of Parliament about the exception three weeks ago, but the entertainment industry is maintaining its campaign to prevent the introduction of a smoking ban in the future.
